1. Acceptance of Terms

These Website Terms of Use ("Terms") govern your access to and use of the websites located at cozyturtle.com and cozyturtle.com, and any related subdomains or pages (collectively, the "Sites"), operated by Cozy Turtle RV Rentals, LLC, Cozy Turtle, LLC, and Cozy Turtle Storage, LLC, each South Carolina limited liability companies (collectively, "Cozy Turtle," "we," "our," or "us"): (a) cozyturtle.com is the primary website for Cozy Turtle RV Rentals, LLC and covers RV rentals, service and repair, and parts and apparel; (b) cozyturtle.com serves as the primary website for Cozy Turtle, LLC and Cozy Turtle Storage, LLC and covers storage services and general business information. By accessing or using either Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

These Terms apply to all visitors, users, and others who access or use either Site, regardless of whether they complete a booking, purchase, or other transaction. Use of our services — including RV rentals, storage, service and repair, and parts and apparel — is separately governed by the Cozy Turtle Terms and Conditions and applicable service agreements available on the Sites.

We reserve the right to modify these Terms at any time. Changes will be posted to the applicable Site(s) with an updated effective date. Your continued use of either Site after any modification constitutes acceptance of the updated Terms.

2. Intellectual Property and Trademarks

All content on the Sites, including but not limited to text, graphics, photographs, images, video, audio, data, software, logos, icons, page layouts, and the overall look and feel of the Sites (collectively, "Content"), is the exclusive property of Cozy Turtle RV Rentals, LLC, Cozy Turtle, LLC, and Cozy Turtle Storage, LLC, as applicable, or their licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

The marks COZY TURTLE™ and MAKE LIFE COZY™, along with all associated logos, trade dress, and brand identifiers, are trademarks owned by Cozy Turtle, LLC (collectively, the "Marks"). Cozy Turtle RV Rentals, LLC and Cozy Turtle Storage, LLC are authorized licensees of the Marks. The Marks are registered or pending registration and are protected under applicable federal and state trademark law. Unauthorized use of the Marks — including reproduction, imitation, or use in connection with any product, service, or business without prior written authorization from Cozy Turtle, LLC — constitutes trademark infringement and may subject the infringing party to legal action.

You may not, without the prior written consent of Cozy Turtle:

1. Copy, reproduce, republish, upload, post, transmit, or distribute any Content from the Site;
2. Use any Content for commercial purposes or in any manner that competes with Cozy Turtle's business;
3. Modify, adapt, translate, create derivative works from, or reverse engineer any portion of the Site or its Content;
4. Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices on the Site or in any Content;
5. Frame or mirror any portion of the Site without express prior written consent;
6. Use any of the Marks in metatags, keywords, search engine optimization, or advertising without prior written consent;
7. Use any automated tools, bots, scrapers, or data mining technologies to collect Content or data from the Site.

Any unauthorized use of the Content or the Marks terminates the limited permission to access the Site granted herein and may constitute copyright infringement, trademark infringement, or other violations of applicable law.

3. Permitted Use

Subject to your compliance with these Terms, Cozy Turtle grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Sites solely for your personal, non-commercial use in connection with exploring Cozy Turtle's products and services, making reservations, and accessing information about our offerings.

You agree to use the Sites only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict or inhibit anyone else's use and enjoyment of the Sites. You agree not to:

1. Use the Site for any unlawful, fraudulent, or harmful purpose;
2. Submit false, misleading, or inaccurate information through any form, booking tool, or communication on the Site;
3. Attempt to gain unauthorized access to any portion of the Site, its servers, or any systems or networks connected to the Site;
4. Transmit any viruses, malware, spyware, or other harmful or disruptive code through the Site;
5. Engage in any conduct that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site;
6. Use the Site to harvest or collect personal information about other users without their consent;
7. Impersonate Cozy Turtle, its employees, or any other person or entity in connection with use of the Site.

4. Booking, Pricing, and Availability

Information displayed on the Sites regarding pricing, availability, product descriptions, and service offerings is provided for general informational purposes and is subject to change without notice. Cozy Turtle makes reasonable efforts to ensure that information on the Sites is accurate and current, but does not warrant that all information is error-free, complete, or up to date at any given time.

In the event that a pricing error, system error, or technical malfunction causes incorrect pricing or availability information to be displayed on the Site, Cozy Turtle reserves the right to cancel or decline to honor any booking, reservation, or order made in reliance on such erroneous information, and to correct the information without liability. You will be notified promptly in the event of such a correction.

Completion of a booking or reservation through the Site is subject to the availability of the requested vehicle or service and to your acceptance of the applicable Rental Agreement, Terms and Conditions, and Damage Protection Package terms, all of which govern the service transaction separately from these Terms.

All prices displayed are subject to applicable state and local taxes in accordance with the South Carolina Sales and Use Tax Act, S.C. Code Ann. § 12-36-910 et seq., and any applicable local option taxes, as disclosed at the time of booking.

5. Privacy

Your use of the Sites is also governed by our Privacy Policy, available at cozyturtle.com/privacy-policy and cozyturtle.com/privacy-policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, disclose, and protect information you provide when using the Sites. By using either Site, you consent to the collection and use of your information as described in the Privacy Policy.

6. Third-Party Links and Content

The Sites may contain links to third-party websites, resources, or services, including but not limited to campground booking platforms, insurance providers, and payment processors. These links are provided for your convenience only. Cozy Turtle does not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party websites or resources. Your use of any third-party website is governed solely by that website's own terms and policies. Cozy Turtle is not liable for any harm or damage arising from your use of or reliance on any third-party website or resource linked from the Sites.

7. Disclaimer of Warranties

THE SITES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COZY TURTLE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. COZY TURTLE DOES NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR FREE OF OTHER HARMFUL COMPONENTS; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITES OR THEIR SERVERS ARE FREE OF HARMFUL ELEMENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COZY TURTLE RV RENTALS, LLC, COZY TURTLE, LLC, AND COZY TURTLE STORAGE, LLC AND THEIR RESPECTIVE MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY DAMAGES RESULTING FROM RELIANCE ON INFORMATION DISPLAYED ON THE SITES, EVEN IF COZY TURTLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE TOTAL LIABILITY OF ALL COZY TURTLE ENTITIES TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SITES EXCEED ONE HUNDRED DOLLARS ($100.00).

9. Indemnification

You agree to indemnify, defend, and hold harmless Cozy Turtle RV Rentals, LLC, Cozy Turtle, LLC, and Cozy Turtle Storage, LLC, and each of their respective members, managers, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of or access to the Sites; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your infringement of any third-party right, including intellectual property or privacy rights; or (e) any content or information you submit to or through the Sites.

10. Electronic Communications

By using the Sites or submitting information through forms, booking tools, or contact features on the Sites, you consent to receive electronic communications from Cozy Turtle, including emails, booking confirmations, and notices. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing, pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN), 15 U.S.C. § 7001 et seq., and applicable South Carolina law.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved in accordance with the dispute resolution process set forth in the Cozy Turtle Terms and Conditions, including the provisions for good faith negotiation, mediation, and binding arbitration. All disputes shall be resolved on an individual basis. You waive any right to participate in any class action or representative proceeding in connection with any dispute arising from your use of the Site.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any legal action or proceeding arising under or relating to these Terms that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Horry County, South Carolina, and you hereby consent to the personal jurisdiction and venue of such courts.

13. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Cozy Turtle with respect to your use of the Sites and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and all remaining provisions shall continue in full force and effect.

Waiver. No failure by Cozy Turtle to enforce any provision of these Terms shall constitute a waiver of that provision or any other provision.

No Relationship. Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and Cozy Turtle.

Assignment. You may not assign or transfer your rights under these Terms. Cozy Turtle may assign its rights and obligations without restriction.
