Definitions

  • “Agreement” means all terms and conditions found in this form, and addenda and any additional materials we provide at the time of Rental.
  • “You” or “your” means the person identified as the renter on this form, any person signing the Agreement, any Authorized Driver and any person or organization to whom charges are billed by us at its or the renter’s direction. All persons referred to as “you” or “your” are jointly and separately bound by this Agreement. This term also includes storage lessees, service and repair customers, and parts and apparel purchasers where the context applies to those services. To qualify as a primary renter for RV rentals, you must be at least 25 years of age, hold a valid driver’s license, and pass our renter verification process.
  • “We,” “our,” or “us” means the private owner(s) and property manager(s) renting the Vehicle to you.
  • “Booking Platform” means the online reservation and booking system used to manage and facilitate rental reservations.
  • “Authorized Driver” means the primary renter identified on this Agreement who is at least 25 years of age, holds a valid driver’s license, and has passed our renter verification process. Because the Vehicle is classified as an automobile for insurance purposes, an Authorized Driver designation is required for all rentals. The Authorized Driver does not operate or drive the Vehicle; Cozy Turtle exclusively handles all delivery, positioning, and retrieval of the Vehicle. This designation exists solely for insurance compliance.
  • “Vehicle” means the recreational vehicle identified in this Agreement. The Vehicle is delivered, set up, and retrieved exclusively by Cozy Turtle RV Rentals staff and remains stationary at the designated rental site for the entire duration of the rental period.
  • “Loss of Use” means the loss of our right to use the Vehicle for any reason because of damage to it or loss of it during Rental. Loss of use is calculated by multiplying the number of days from the date of damage to the Vehicle until it is repaired or replaced times the nightly rental rate.

Important Disclosures

  • By signing this Agreement, you understand and agree that you assume all liability, whether collision, damage, or liability for the entire duration of the Rental. You agree to indemnify the Owner(s) and Property Manager(s) of the RV in any suit brought against them.
  • Cozy Turtle RV Rentals LLC insures its fleet through American Modern Home Insurance Company, administered through MBA Insurance Division (Policy No. 01C405015), with a liability limit of $1,000,000 Combined Single Limit for bodily injury and property damage per accident. This coverage protects Cozy Turtle as the named insured and is separate from the coverage extended to renters.
  • Renters are added as Additional Insureds under Endorsement 75006 of Cozy Turtle’s policy for the duration of the rental period. Renter liability coverage limits under this endorsement are: Bodily Injury $25,000 per person and $50,000 per accident; Property Damage $25,000 per accident. This coverage is extended to the renter only during the authorized rental period and only for the specific Vehicle identified in the Reservation Agreement. Coverage under this endorsement is voided in its entirety if the Vehicle is used or operated in breach of the terms and conditions of this Agreement.
  • Renters who wish to obtain additional liability protection beyond the limits provided under Cozy Turtle’s policy may purchase Supplemental Liability Insurance (SLI) through MBA Insurance at mbainsurance.net/supplemental-liability-insurance.php. SLI is excess coverage that may provide up to $500,000 in additional bodily injury protection and is subject to MBA’s terms and conditions. Cozy Turtle does not administer SLI and makes no representations regarding its availability or terms.
  • As a condition of rental, you are required to provide a copy of your valid driver’s license and proof of a valid personal automobile or recreational vehicle insurance policy at or before the time of delivery. This is required under the terms of Cozy Turtle’s insurance policy. Failure to provide proof of a valid driver’s license and insurance at or before delivery may result in cancellation of the rental without refund.
  • A Damage Protection Package is required for all rentals and must be selected at the time of booking. These packages reduce your financial responsibility for covered accidental damage to the Vehicle during the rental period but do not constitute an insurance policy and do not provide liability coverage. Full details are set forth in Section 15 of these Terms and Conditions.
  • You must report all accidents involving the Vehicle to us and the police within 24 hours of occurrence.
  • By signing this Agreement, you understand and agree that there may be optional products that you may or may not opt to add on to your Rental. You also understand and agree that there are conditional fees that may or may not be charged to you after the Rental has been completed based on usage and damages.

Terms and Conditions

Part I – RV Rental Terms

  1. You, the Renter, do hereby agree to rent the vehicle identified in the Reservation Agreement from Cozy Turtle RV Rental (Property Manager) under the following terms and conditions:
  2. The rental shall be from the dates set forth in the Reservation Agreement.
  3. The sum of the rental shall be outlined in the Reservation Agreement.
  4. You understand that the sum of the rental includes charges for add-on items.
  5. Taxes. All rental rates, fees, and charges are stated before tax. The total amount due, including nightly rental rates, delivery fees, prep and sanitization fees, wastewater fees, Damage Protection Package rates, and any other charges or add-on items, is subject to applicable state and local taxes in accordance with the South Carolina Sales and Use Tax Act, S.C. Code Ann. § 12-36-910 et seq., and any applicable local option taxes as may be levied by the applicable county or municipality. Applicable taxes will be calculated and disclosed at the time of booking.
  6. You agree to pay any propane charges to refill, if necessary, out of the security deposit.
  7. Additional charges include a wastewater dumping charge of $50, if applicable, and delivery fee of $4.00 per mile travel mile beyond 50 miles for delivery. You agree to pay these charges, if necessary.
  8. You understand that the sum of the rental includes a prep and sanitization fee outlined in the Reservation Agreement and that Cozy Turtle has the right to charge additional cleaning fees as necessary up to $500 if standard cleaning is not enough.
  9. You understand that a cleaning fee is not the same as a prep and sanitation fee which is not the same as a wastewater dumping fee.
  10. Pets are permitted subject to a mandatory, non-refundable pet fee collected at the time of booking. Any damage caused by pets during the rental period is subject to the Damage Protection Package deductible and applicable charges in addition to the non-refundable pet fee.
  11. Smoking/vaping is not permitted in the vehicle. If there is evidence of smoking, vaping, or other strong odors, you will be subject to the additional cleaning fee up to $500 plus potential forfeiture of your entire security deposit, at the manager’s/owner’s discretion.
  12. The refundable security deposit for rentals is $500 minimum up to a maximum of $1,500 depending on the size and value of the vehicle you reserve.
  13. The Security Deposit, less any amounts applied for charges owed under this Agreement, will be released within seven (7) business days following completion of Cozy Turtle’s post-retrieval inspection. If the full extent of any damage cannot be determined within that period, Cozy Turtle will notify you of the delay and the reason therefor.
  14. No refund will be given if you prepay for a service but do not use it including add-on items.
  15. Damage Protection Package. A Damage Protection Package is mandatory for all rentals and must be selected at the time of booking. The following tiers are available: (a) Essential Protection at $20 per night with a $1,500 deductible per incident, which includes standard damage protection coverage, 24/7 support line, incident support coordination, and standard claims processing; (b) Enhanced Protection at $30 per night with a $750 deductible per incident, which includes all Essential features plus priority support response, expedited claims processing, minor damage forgiveness for cosmetic damage under $150 (applicable to rentals of 4 or more nights only; not available for rentals of fewer than 4 nights), and trip interruption assistance; (c) Elite Protection at $40 per night with a $250 deductible per incident, which includes all Enhanced features plus minor damage forgiveness for cosmetic damage under $300 (applicable to rentals of 4 or more nights only), trip interruption reimbursement up to $150 per night for a maximum of two nights, mobile technician dispatch coordination, priority replacement RV assistance subject to availability, and cleaning fee forgiveness up to $300 (applicable to rentals of 4 or more nights only). In addition, a Deductible Waiver is available as an optional add-on for $150 and reduces the applicable deductible by $500 across any tier, up to a minimum deductible of $0. These packages reduce but do not eliminate financial responsibility for covered accidental damage. They are not insurance policies and do not provide liability coverage. Coverage applies only to accidental damage occurring during the rental period and excludes damage resulting from negligence, prohibited uses, breach of this Agreement, water leakage or seepage from plumbing or climate control systems, or violations of this Agreement. All Damage Protection Package tier rates are subject to applicable taxes as provided in these Terms.
  16. Delivery and Setup. Cozy Turtle will deliver the Vehicle to the rental site designated in the Reservation Agreement on the scheduled delivery date and time. Upon delivery, Cozy Turtle staff will set up and level the Vehicle, connect utilities (water, electric, and sewer as available at the site), and ensure the Vehicle is operational, including that the refrigerator is cooling and climate control is functioning. You must be present or have an authorized representative present at the time of delivery to accept the Vehicle, acknowledge its condition, and provide a copy of your valid driver’s license and proof of insurance as required under these Terms.
  17. Site Accessibility. You are solely responsible for ensuring that the designated rental site is accessible and suitable for delivery and retrieval of the Vehicle. This includes but is not limited to: (a) confirming with the campground or property owner that the site accommodates the size and dimensions of the Vehicle reserved; (b) ensuring adequate road clearance, surface stability, and turning radius for the delivery vehicle; and (c) providing accurate site location information in advance. If Cozy Turtle arrives for delivery and the site is inaccessible or unsuitable, Cozy Turtle may, at its sole discretion: (i) coordinate a site change with the campground at your expense; or (ii) cancel the delivery entirely, in which case no refund or credit will be issued. Any fees charged by the campground for site changes are your sole responsibility.
  18. Retrieval. Cozy Turtle will retrieve the Vehicle from the rental site on the scheduled retrieval date and time. You must ensure that the rental site is clear, accessible, and that the Vehicle is ready for retrieval by the agreed-upon time, but no later than noon EST on the retrieval date. You remain responsible for the Vehicle and any damage or loss until Cozy Turtle staff completes retrieval and inspection. If the site is not cleared and accessible for retrieval by the agreed-upon time, you will be charged a late clearance fee of $50.00 per hour, accruing in one-hour increments, which compounds indefinitely until Cozy Turtle is able to complete retrieval.
  19. Cancellation Policy. The following cancellation terms apply to all RV rental reservations. Credits are valid for 24 months from the date of issuance and may be applied to future reservations. Credits are offered first in all scenarios as the preferred form of reimbursement. A non-refundable administrative fee of $50.00 will be deducted from any cash refund issued under any tier to cover credit card processing and administrative costs. The administrative fee does not apply to credits. Non-refundable fees, including but not limited to the pet fee and prep and sanitization fee, are excluded from any credit or refund regardless of cancellation timing. (a) 30 or More Days Before Delivery: Cancellations made 30 or more days prior to the scheduled delivery date are eligible for a full credit with no fee. If a cash refund is requested rather than a credit, the $50.00 administrative fee will be deducted from the refund amount. (b) 15 to 29 Days Before Delivery: Cancellations made 15 to 29 days prior to the scheduled delivery date are eligible for a full credit. A 50% cash refund is available at Cozy Turtle’s discretion and is subject to the $50.00 administrative fee. (c) Fewer Than 14 Days Before Delivery: Cancellations made fewer than 14 days prior to the scheduled delivery date are eligible for a credit at Cozy Turtle’s discretion. A cash refund is available solely at Cozy Turtle’s sole discretion and is subject to the $50.00 administrative fee. (d) Qualifying Circumstances: Where a cancellation results directly from a mandatory evacuation order issued by Horry County or South Carolina state authorities affecting the rental site or Renter’s place of origin, a government-declared state of emergency that directly prevents delivery or access to the rental site, or a regulatory order or legal prohibition preventing Cozy Turtle from performing the rental, Cozy Turtle may issue a full credit at its discretion. A cash refund in qualifying circumstances is available at Cozy Turtle’s discretion and is subject to the $50.00 administrative fee. The following circumstances do not automatically qualify but may be considered at Cozy Turtle’s discretion: hurricane or tropical storm watches or warnings not accompanied by a mandatory evacuation order, personal emergencies, medical situations, or other extenuating circumstances. (e) Discretionary Authority: Cozy Turtle reserves the right at its sole discretion to issue a full or partial credit or refund in any circumstance not covered above. The exercise of this discretion in any instance creates no obligation to do so in future instances. Cozy Turtle reserves the right to modify this cancellation policy and will provide notice of any changes prior to their effective date.
  20. Early Retrieval. No refund or credit will be issued for any unused portion of the rental period resulting from early retrieval requested by the renter. The full rental rate applies regardless of whether the Vehicle is retrieved prior to the scheduled retrieval date.
  21. You release the Property Manager(s) and­ (Owner(s) ­from all claims for loss of, or damage to, your personal property or that of any other person, which is left or carried in the vehicle.
  22. You agree to pay us on demand for all charges due us under this Agreement, including but not limited to: (a) time for the period during which you take the Vehicle; (c) charges for the optional services; (d) applicable taxes if any; (g) all costs, including pre- and post-judgement attorney fees, legal fees and court costs we incur collecting payment from you or otherwise enforcing our rights under this Agreement; (h) a “loss of use” fee if the Vehicle is rendered unusable or unrentable due to damage, calculated at the applicable nightly rental rate for each day the Vehicle is out of service from the date of damage until it is returned to rentable condition; (h) we will not refund any charges if you request early retrieval prior to the scheduled retrieval date.
  23. You have truthfully disclosed the identity and proper age of all renters and confirmed that the primary renter is at least 25 years of age as required by our insurance carrier.
  24. You agree to return the vehicle in the same condition in which it is received. This includes odor-free and clean in the interior of the RV.
  25. You have read and agree to all rental rates.
  26. No Movement of Vehicle. The Vehicle shall remain stationary at the designated rental site for the entire duration of the rental period. Only Cozy Turtle RV Rentals staff may move, reposition, tow, or transport the Vehicle at any time. You, your guests, or any third party are strictly prohibited from moving, repositioning, hitching, towing, or otherwise attempting to relocate the Vehicle for any reason. Any unauthorized movement of the Vehicle shall constitute a material breach of this Agreement, will void insurance coverage provided under Endorsement 75006, and may result in immediate termination of the rental, forfeiture of the security deposit, and liability for all resulting damages.
  27. Awning and Slide-Out Use. The use of awnings and slide-outs is permitted during your rental. You are responsible for proper operation and for monitoring conditions that could result in damage. You are financially responsible for any damage to the awning or slide-outs caused by your actions or inactions during the rental period, including but not limited to damage resulting from failure to retract the awning during inclement weather, high winds, or storms. Damage resulting from a sudden and unforeseeable act of nature that could not reasonably have been prevented is excluded from your financial responsibility.
  28. Water and Weather Damage. You are responsible for ensuring all windows, vents, roof hatches, and exterior openings are properly closed and secured during inclement weather or when the Vehicle is unattended. Damage resulting from rain, moisture, or water intrusion through openings left unsecured by you is not covered under the policy or Damage Protection Package and shall be your sole financial responsibility. Additionally, damage resulting from continuous or repeated seepage or leakage of water from plumbing, heating, or air conditioning systems is excluded from coverage under the policy and Damage Protection Package.
  29. You are responsible for checking and maintaining all fluid levels during the rental period. This includes checking the generator oil daily if you use the generator.
  30. Unless authorization is obtained from the manager(s) or owner(s), no repairs, replacement of parts or service shall be completed during the Rental period.
  31. The manager(s)/owner(s) are not responsible for the loss of vacation, personal or business time, or any incidental expenses incurred by the renter, resulting from breakdown or any other delay problems. The manager(s)/owner(s) shall be responsible for completing any necessary repairs and returning the vehicle to Rental condition as promptly as possible.
  32. You are responsible for reporting all accidents, incidents of vandalism or theft to the police and the manager(s)/owner(s) upon discovery.
  33. You agree that no person other than Cozy Turtle RV Rentals staff shall operate, drive, or attempt to move the Vehicle at any time. All renter information provided in this Agreement is accurate and complete.
  34. You agree that all insurance information provided is true and valid. You acknowledge that you have provided a copy of your valid driver’s license and proof of a valid personal automobile or recreational vehicle insurance policy as required under these Terms and as required by the terms of Cozy Turtle’s insurance carrier. You understand that failure to maintain valid insurance during the rental period or providing false insurance information may void coverage under Cozy Turtle’s policy endorsements.
  35. We may use your security deposit to pay any amounts owed to us under this Agreement, which shall include replacement of fuel or LP gas, wastewater dumping, time and mileage, loss or damage to the vehicle, administrative or legal fees, fines, penalties, forfeitures, court costs, towing and storage charges and other assessed charges, unless the expenses are our fault, all costs associated with locating and recovering the vehicle, if you fail to return the vehicle as required by the terms of the Rental Agreement. If the amount of your security deposit is insufficient to satisfy all amounts due, then you agree to pay all charges in excess.
  36. This is an Agreement for Rental of the Vehicle. We may repossess or arrange retrieval of the Vehicle at your expense without prior notice if the Vehicle is determined to have been moved from the designated rental site, is abandoned, or is being used in violation of law or this Agreement. You agree to indemnify us, defend us, and hold us harmless from all claims, liability, costs and attorney fees we incur resulting from or arising out of, this Rental and your use of the Vehicle.
  37. We make no warranties, express, implied or apparent, regarding the Vehicle, no warranty of merchantability and no warranty that the Vehicle is fit for a particular purpose.
  38. You must ensure that the Vehicle is accessible and ready for retrieval at the designated rental site on the date and time specified in this Agreement, and in the same condition that you received it, except for ordinary wear. Cozy Turtle will perform retrieval and transport of the Vehicle.
  39. If the Vehicle is not accessible for retrieval after the specified time, you remain responsible for the safety of, and any damage to, the Vehicle until we complete retrieval and inspection.
  40. The following acts or uses of the Vehicle are prohibited and will constitute a material breach of this Agreement, void insurance coverage under Endorsement 75006, and may result in immediate termination of the rental, forfeiture of the entire security deposit, and liability for all resulting damages: (a) moving, repositioning, hitching, towing, or otherwise attempting to relocate the Vehicle by anyone other than Cozy Turtle RV Rentals staff; (b) allowing any person to operate or drive the Vehicle; (c) obtaining the Vehicle or extending the rental period by providing false, fraudulent, or misleading information; (d) using the Vehicle in furtherance of any illegal purpose; (e) carrying dangerous, hazardous, or illegal materials in or on the Vehicle; (f) loading the Vehicle beyond its rated capacity as specified by the manufacturer; (g) allowing anyone under the influence of drugs or alcohol to occupy or use the Vehicle in a manner that creates risk of damage; (h) failing to summon the police to any accident or incident involving the Vehicle that causes personal injury or property damage; (i) damaging the Vehicle by intentional, wanton, or reckless conduct; (j) allowing anyone to sit, stand, or lie on the roof of the Vehicle; (k) placing tire chains, signs, lettering, paint, speakers, or other sound or visual equipment on the exterior of the Vehicle without prior written consent; (l) taking or relocating the RV to a festival, event, or location other than the designated rental site without prior written notification to and approval from Cozy Turtle; (m) disabling or tampering with any GPS or tracking device if the Vehicle is so equipped; (n) causing damage to the Vehicle through failure to follow operating instructions provided at delivery; (o) failing to close and secure all windows, vents, roof hatches, and exterior openings during inclement weather or when the Vehicle is unattended; (p) failing to report damage, accidents, theft, or vandalism to Cozy Turtle and the appropriate authorities upon discovery.
  41. You release us from all claims for, loss of, or damage to, your personal property or that of any other person, that we received, handled or stored, or that was left or carried in or on the Vehicle, whether or not the loss or damage was caused by our negligence or was otherwise our responsibility.
  42. Electronic Signatures. Your electronic acceptance of these Terms and Conditions through our booking platform or any other electronic means constitutes your valid, binding signature and agreement to all terms herein, pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN), 15 U.S.C. § 7001 et seq., and applicable South Carolina law. Electronic signatures have the same legal force and effect as original handwritten signatures and may not be challenged solely on the basis that they are in electronic form.
  43. Force Majeure. Cozy Turtle shall not be liable for any failure or delay in delivery, setup, retrieval, or performance of obligations under this Agreement resulting from circumstances beyond our reasonable control, including but not limited to acts of God, severe weather events, natural disasters, flooding, road closures, government actions, or other events that render delivery or retrieval impossible or unsafe. In such circumstances, Cozy Turtle will make reasonable efforts to reschedule delivery or retrieval and will communicate with you as promptly as practicable. Credits may be issued at Cozy Turtle’s sole discretion for documented force majeure events that prevent the commencement of the rental period.
  44. Dispute Resolution. In the event of any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or any service provided by Cozy Turtle, the parties agree to the following resolution process: (a) Good Faith Negotiation: The parties shall first attempt to resolve the dispute through good faith discussion and written notice of the dispute for a period of 30 days; (b) Mediation: If the dispute is not resolved through negotiation, the parties agree to submit it to non-binding mediation in Horry County, South Carolina, before a mutually agreed mediator, with costs shared equally; (c) Binding Arbitration: If mediation is unsuccessful, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in Horry County, South Carolina. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction; (d) Individual Claims Only: All disputes shall be resolved on an individual basis. You waive any right to participate in any class action, collective arbitration, or representative proceeding; (e) Small Claims Exception: Either party may bring an individual claim in a court of appropriate limited jurisdiction for disputes within that court’s jurisdictional limits without first completing the negotiation, mediation, or arbitration steps above.
  45. Trademark Notice. COZY TURTLE™ and MAKE LIFE COZY™ are trademarks owned by Cozy Turtle, LLC, a South Carolina limited liability company. Cozy Turtle RV Rentals, LLC and Cozy Turtle Storage, LLC are authorized licensees of these marks. All rights reserved. Unauthorized reproduction, imitation, or use of these marks in connection with any product, service, or business without prior written authorization from Cozy Turtle, LLC constitutes trademark infringement under applicable federal and state law.
  46. No term of this Agreement can be waived or modified except by a writing that we have signed. This Agreement constitutes the entire Agreement between you and us. All prior representations and Agreements between you and us regarding this rental are merged into this Agreement. The laws of the state of South Carolina and Horry County govern this Agreement. In the event of any conflict between these Terms and Conditions and a Cozy Turtle RV Rental Agreement executed in connection with a specific rental transaction, the Rental Agreement shall govern for that rental-specific matter.
  47. Certain items are considered non-essential convenience items. If they fail to work during a trip, no adjustments will be made to your charges. No troubleshooting by the Property Manager(s) or Owner(s) during the trip will be done for these items if there are issues. These include TVs, antennas, CD and DVD players, radios, satellite radios, GPS navigation hardware and software, hairdryers, fans, coffee makers, vacuum cleaners, artificial fireplaces, swiveling seats, and left/right/rear cameras, if equipped.
  48. A waiver by us of any breach of this Agreement is not a waiver of any additional breach or waiver of the performance of your obligations under this Agreement. Our acceptance of payment from you or our failure, refusal, or neglect to exercise any of our rights under this Agreement does not constitute a waiver of any other provision of this Agreement. Unless prohibited by law, you release us from any liability for consequential, special, or punitive damages in connection with this Rental or the reservation of a vehicle.
  49. You will indemnify, defend, and hold us harmless from and against any claim arising out of unsafe fueling practices committed by you or your agent. If any provision of this Agreement is deemed void or unenforceable, the remaining provisions are valid and enforceable.
  50. By signing the RV Rental Agreement, you acknowledge that you have been given an opportunity to read the RV Rental Agreement in its entirety, including the Terms and Conditions before being asked to sign. Your signature authorizes us to process payment from you for all charges due under this Agreement, including later payment of any traffic, toll, or parking violations assessed against the Vehicle. Part II – Storage Services

  1. Scope. The following provisions apply to all storage services provided by Cozy Turtle Storage, LLC at its storage facility. By entering into a Storage Lease Agreement with Cozy Turtle, you agree to these Terms in addition to the terms of your individual Storage Lease Agreement. In the event of a conflict between these Terms and the Storage Lease Agreement, the Storage Lease Agreement shall govern.
  2. Unit Assignment. Storage units are assigned by Cozy Turtle based on availability and the size requirements of the stored property. Unit assignments are personal to the lessee and are non-transferable without prior written consent from Cozy Turtle.
  3. Access. Access to the storage facility is available during posted facility hours. Access codes and credentials are personal to the lessee and must not be shared with unauthorized persons. Unauthorized sharing of access credentials may result in immediate termination of the storage lease without refund of prepaid amounts.
  4. Prohibited Items. The following items may not be stored in any unit: flammable, combustible, or explosive materials; hazardous chemicals or toxic substances; illegal substances or contraband; perishable food or organic matter; living animals or plants; and any items the storage of which is prohibited by applicable law or regulation. Cozy Turtle reserves the right to require immediate removal of any prohibited item and may report prohibited items to the appropriate authorities.
  5. Renter’s Insurance. Cozy Turtle does not provide insurance for property stored at the facility. Lessees are solely responsible for obtaining and maintaining their own insurance coverage for all stored property. Cozy Turtle and its members, managers, and agents are not liable for loss, theft, damage, or destruction of stored property from any cause, including but not limited to fire, flood, weather events, vandalism, theft, or mechanical failure of facility systems.
  6. Payment and Late Fees. Storage lease rates, payment due dates, and applicable late fees are set forth in the individual Storage Lease Agreement. Late fees will be assessed in accordance with the terms of the Storage Lease Agreement.
  7. Default and Lien Rights. In the event of default on payment obligations or material breach of the Storage Lease Agreement, Cozy Turtle reserves all rights and remedies available under applicable law, including lien rights pursuant to the South Carolina Self-Service Storage Facilities Act, S.C. Code Ann. § 39-20-10 et seq. Cozy Turtle may deny access to the storage unit upon default and may proceed with a lien sale following proper notice as required by law.
  8. Move-Out Requirements. Upon termination of the storage lease for any reason, the lessee must remove all stored property and leave the unit in clean, undamaged condition by the final day of the lease period. Units not vacated by the termination date will be subject to continued charges at the applicable daily or monthly rate until the unit is fully vacated and returned to Cozy Turtle.
  9. Abandoned Property. Property remaining in a storage unit following default and completion of the lien enforcement process will be deemed abandoned and disposed of by Cozy Turtle in accordance with applicable South Carolina law. Cozy Turtle shall have no liability for disposed property following completion of the statutory lien process.

Part III – Service and Repair

  1. Scope. The following provisions apply to all mobile service, repair, diagnostic, and inspection work performed by Cozy Turtle on recreational vehicles and related equipment. By signing a service work order, you authorize Cozy Turtle to perform the described services and agree to pay all applicable rates and charges.
  2. Written Authorization Required. No service, repair, diagnostic work, or inspection will be performed without a signed written work order authorization from the vehicle owner or their authorized representative. Verbal authorizations are not binding on Cozy Turtle and do not create an obligation to perform work.
  3. Service Rates. Cozy Turtle’s current service rates are available upon request and will be provided and agreed upon at the time of scheduling or booking. All service calls are subject to an Initial Visit Rate that includes a trip charge and the first hour of labor. After the first hour, labor is billed in 15-minute increments. Trip charges may vary based on client history and distance traveled. All rates are subject to change with reasonable notice and are subject to applicable state and local taxes as set forth in these Terms. Current rates will be disclosed in writing prior to commencement of any service work, and your authorization of the work order constitutes agreement to the quoted rates.
  4. Estimates and Additional Work Authorization. If the scope of required work identified during the service call exceeds the originally authorized work, Cozy Turtle will contact you for additional written or verbal authorization before proceeding. Work will not be performed beyond the originally authorized scope without your approval. If authorization for additional work cannot be obtained within a reasonable time, Cozy Turtle will complete the originally authorized scope only and provide a written summary of additional recommended repairs.
  5. Declined Repairs. If you decline to proceed with recommended repairs after a diagnostic visit or estimate, the Initial Visit Rate and all charges for time already incurred remain due and payable in full. Decline of recommended repairs does not waive any charges for work already performed or time already spent.
  6. Payment Terms. Payment for all service and repair work is due in full upon completion of services. Cozy Turtle accepts cash, check, debit card, credit card, and ACH payment. Returned checks are subject to applicable returned check fees under South Carolina law. Cozy Turtle reserves the right to retain possession of a vehicle until all outstanding charges are paid in full and reserves all lien rights available under applicable law, including S.C. Code Ann. § 29-15-10 et seq.
  7. Unclaimed Vehicles. Vehicles not retrieved within 30 days of written or verbal notification that service has been completed may be subject to daily storage charges at the applicable rate. After 30 days, Cozy Turtle may, following written notice to the vehicle owner at their last known address, assert a mechanic’s lien and proceed with a lien sale in accordance with S.C. Code Ann. § 29-15-10 et seq.
  8. Personal Items. Cozy Turtle is not responsible for loss of or damage to personal items, valuables, or property left in or on the vehicle during service. Customers are advised to remove all personal items prior to service.
  9. Pre-Existing Conditions. Cozy Turtle will document the pre-existing condition of the vehicle at the time of each service call. Cozy Turtle is not liable for pre-existing damage, wear, deterioration, or mechanical conditions identified at intake and unrelated to the authorized scope of work. Cozy Turtle makes no warranty that authorized repairs will resolve issues caused by or related to pre-existing conditions.
  10. Limitation on Warranty of Service. Cozy Turtle will perform all authorized work in a professional and workmanlike manner. Cozy Turtle makes no warranty that repairs will permanently resolve all identified issues, particularly where underlying conditions, owner neglect, or factors outside the scope of the authorized work contribute to recurring problems.

Part IV – Parts and Apparel Sales

  1. Scope. The following provisions apply to all sales of parts, accessories, apparel, and merchandise by Cozy Turtle, whether in person or through any online or booking platform.
  2. Availability and Substitution. All parts and apparel items are subject to availability at the time of purchase or order. Cozy Turtle reserves the right to substitute items of equal or greater value and comparable specification where an ordered item becomes unavailable, with prior notification to the customer. Cozy Turtle is not liable for delays caused by supplier availability or shipping conditions.
  3. Pricing and Taxes. All prices are subject to change without notice prior to the completion of a purchase. All sales are subject to applicable state and local taxes in accordance with the South Carolina Sales and Use Tax Act, S.C. Code Ann. § 12-36-910 et seq., and any applicable local option taxes. The applicable tax will be calculated and disclosed at the point of sale.
  4. Returns and Exchanges. Parts and apparel may be returned or exchanged within 30 days of the original purchase date, subject to the following conditions: (a) the item must be in its original, unused, and uninstalled condition with all original packaging intact and original receipt presented; (b) electrical components are non-returnable under any circumstances once removed from original packaging; (c) parts that have been installed, modified, or show evidence of use are non-returnable; (d) apparel from which tags have been removed is non-returnable; (e) special order items are non-returnable once ordered from the supplier. Cozy Turtle reserves the right to decline returns that do not meet these conditions.
  5. Special Orders. Special order items require a non-refundable deposit at the time of order, the amount of which will be specified at the point of sale. In the event that a special order is cancelled by the customer after the item has been ordered from the supplier, the deposit is forfeited. If the order cannot be fulfilled by Cozy Turtle due to supplier unavailability, the deposit will be refunded in full.
  6. Manufacturer Warranty. Parts and apparel are covered only by any applicable manufacturer’s warranty. Cozy Turtle makes no independent warranty on parts or apparel beyond what is expressly provided by the manufacturer. Warranty claims must be submitted in accordance with the applicable manufacturer’s warranty process and timeline. Unless separately agreed in writing, labor costs associated with the replacement of a warranted part are not included in the manufacturer’s warranty and are the responsibility of the customer.
  7. Damaged or Defective Items. Claims for items that arrive damaged or are found to be defective must be reported to Cozy Turtle within 7 days of receipt. Cozy Turtle will facilitate the warranty, replacement, or return process with the manufacturer or supplier where applicable. Claims reported after 7 days may not be eligible for facilitation by Cozy Turtle.
